2006 Proxy Vote Counting.
This is in response to the posting that included: "I now believe our attention should focus on the Proxy/Votes and process" 3.) I would ask that an accounting of votes that were disallowed and for what reason be required (large discrepancy/questions in last years voting and count).
I was included in the group led by Mr. Don Engle to count the 2006 Proxies. I can tell you with definite knowledge that those proxies were counted, recounted, reviewed by our counting partner, and audited with running tape twice. You read that correctly, we ran the tapes twice and they were also reviewed and stapled to the stack of proxies for future auditing use if needed.
If you recall we went to the room about 1:00pm and exited to give the results after 6:30pm. The proxy counting process in 2006 was thorough and honest. If you would like to be included in the process this year ask the front office for information on the process and volunteer.

Thank you Brian for your clarification of the election results.
I have a problem with the voting – the total picture – the fact that it is not a secret ballot. After the board made a big scene with Mr. Toth - I recently found out that the proxies held by Mr Donato were counted in the election. the board had the gall to count Mr Donato’s proxies, even thought he was allegedly behind in his maintenance last year. Did the committee counting the votes have any access to the maintenance records? Could you confirm that all of the owners whose votes were counted were up to date in their payments?

What you didn't say is how can any proxy be validated?
Did you check the signatures? Were you able to take 15 or 20 of those proxies at radom and call to validate them?
Where they certified as the present Coral Beach Attorney for the Board Ms. Tiffany Dennison strongly recommended?
Did you validate that Mario Donato and all other others owners were really up to date in their maintenance charges?
Since none of us were able to look at the books, who the heck would really know?
Not you that is for sure! Not me either!!
So do not give me that crap that Santa Clause is making the list and he is checking it twice!!!!

I know you guys spent a long time verifying the count, great and thank you.
But; the question had to do with how many votes were dissallowed and for what reason(s).
Am I questioning if there had been any impropriety ... yup!
Do I have a right to question ... yup!
My paranoia is in direct proportion to the goings on at Coral Beach under the direction/leadership of the current BOD.
Am I justified ... yup!

All of your comments are valid and invaluable in the process. I ask that you get involved in the scrutineering process that includes validation and counting this year.
I feel that the 2006 counting was valid and honest. The ballots were scrutinized for latest date and signature comparisons (if two ballots were present), signature, maintenance balance, number of candidates marked as voted for. The process was fair and I think everybody in the room will state this fact.

I know my concerns were not so much with the people that counted the votes.
My concerns were and continue to be with the possiblity that proxies were altered, discarded or disqualified prior to the count.
I think the current board has put themselves in a very questionable position by refusing to follow the policies set forth in the Governance Committee.
There should not be board members on the nominating committee. The board members should not decide who counts the votes. The proxies should be going to a third party, such as the attorney or auditing firm, and I don't mean Mr. Hardy. The proxies should be verified, which could be done easily if a third party was receiving them. We've paid a small fortune in legal fees for issues that could've been resoved by sensible people. Paying to ensure a fair election would be worth it to me.
If the board honestly believes what they proclaim about being fair and doing the best for Coral Beach, why is there such a need for them to control the election?
Here is a suggestion:
I also felt that there may have been things done underhanded. Not by the counters, but by the board.
They seem to already have and advantage over these independents. No resumes went out to the owners, but information endorsing the
(7) by the BOD's was emailed to all. By our own Coral Beach workers.
Let the independents pick 5 people and let the board pick the other 5 people to count the proxies. That would be smart since they have nothing to hide!
Proof would have to be supplied and notorized by our bookkeeper that what records he is suppling the counters with are accurate and if questions are asked, answers must be produced to support the questions.
All proxies in order to be fair should be verified, all owners should be called. We as an owner may not know the results until the next day, but hey maybe this can make everybody happy.
Meahwhile I don't necessarily want the board or anybody for that matter to know who I voted for. Lock those proxies in a neutral
3rd party safe. Not Tiffany Dennison.
If there is nothing at all to hide, why not guys???
My only question to the BOD's would be why would you not want to do this????? It so makes sense.
It might make everyone happy in the end.
Owners might like to know that these are some of the questions we had for Legal Counsel when we met her on Oct 11th and she promised a written reply by the end of that month. During that meeting Ms Dennison confirmed that she had already sent her opinions on some of these matters to the Board in 2006 and was surprised to hear that none of the changes recommended had been introduced. At the Forum on 28th Dec. the President said that the opinions would be available after the Board had digested them. Today we have written to the Board asking for sight of these opinions, particularly as we have paid $300 for them.
