The legal opinion saga.......

Over the weekend we were informed by CBH Accounts that $300.00 was being added to our maintenance bill for legal services.

As regular readers of this blog will know, we have yet to receive the written legal opinion we asked for on October 10th regarding the submissions for nominations to the Board. (note: all parties knew they closed on November 15th). Thus the opinion will have no use for the 2008 AGM but may have some value in the future. Who knows?

We must wait and see, as Ms Dennison has informed us today that she is still in the process of completing the document before sending it to the Board. It will also contain opinions on a number of other questions raised by other Owners. Ms Dennison confirmed to us this morning that we would be able to read that opinion. We have asked that we be billed directly as we had met her independently of any CBH Board, Management or Group and that being so, the billing has nothing to do with CBH and is a personal matter.

The meeting was short and interesting and demonstrated some of the complexities involved in dealing with all the various parties' interests in Coral Beach Hotel.

On another tack, work continues apace around and about the terraces and roofs. The 'hot gun' is in action again and the roofers are checking out particular work yet to be done. It is cooler today but very breezy, so I don't think it can be too much fun up there.

In answer to a comment (that I have not published) let me say that Geoff and I arranged a personal appointment with the Legal Counsel which we expected to be billed for directly. No indication was given that any other party would be involved.

Let me get this straight. You met with Mrs. Dennison, who represents the SHAREHOLDERS, 6 weeks ago. You asked for a legal opinion which affects all SHAREHOLDERS and offered to pay for her services yourselves.

Now SIX weeks later you still don't have it because it isn't done and were told it would be presented to the Board.

This just doesn't sound right. I would've thought that if you were paying for an opinion, you should get it. And if she wasn't able to provide it directly to you, should not have agreed to write it. Or am I missing something?

Has anyone received any AGM information in the mail yet? It is coming up fast and I ahve not received anything about the Proxy or nominees. Any information that would shed light on this is much welcomed.

Truley worrisome that whenever Ms. Dennison's name crops up in reference to getting a legal opinion on some very (or on any) important questions ... the only answer I ever read is NOT TODAY.

Are we overdue or not paying our attorneys legal bill or is the legal counsel provided to Coral Beach owners being billed pro bono (free).

I feel like the needs of the owners of CB are at the back of the bus.

Maybe Ms. Dennison case load is busy with more important legal matters/clients.

Doesn't seem right now does it.

Some popular concerns about the following that require immediate attention a clear interpertation, and some legal guidance:
Upcomming AGM, Proxy's, Phil's bankruptcy, Bruno's deportation and more importantly his business relationship with Mario & the $2 store, possible conflict of interest accusations, and lack of documented accountability, etc., etc., etc.

An Open letter to Ms. Tiffany Dennison,
Ms. Dennison, as a Bahamian and an Owner/Shareholder at Coral Beach, Please be reminded that the deadline for Nominations has come and gone, your response was requested in a timely manner, and in the past your yourself reminded the owners that you are supposedly there for all of the Owners, not just the Board. Well now, this Bahamian owner is not going to sit around and allow this "so-called" board to play some skull-duggery games. The rules must be for all. Face the facts, this BOD has been breaking the rules for a long time, last year there was some controversy over an allegedly stolen letterhead from your practice. I hope that all of the owners and Shareholder will hear something from you as soon as possible.
